Adityanath Govt In UP To Suspend Key Labour Laws, Workers Rights For 3 Years

Uttar Pradesh government has declared an ordinance for suspension of most of the labour laws for three years. In its latest meeting, the state cabinet passed this ordinance to revive economic activities in the state that have been hit hard due to the coronavirus.

The meeting was chaired by Chief Minister of UP, Yogi Adityanath. UP cabinet gave the green signal to the ‘Uttar Pradesh Temporary Exemption from Certain Labour Laws Ordinance, 2020‘. In this all labour laws in the state have been suspended except for three laws; abolishment of bonded labour, ex gratia to workers in case of work-related diseases and disabilities, and timely wage payments.

In a statement, the Uttar Pradesh government said that the nation-wide lockdown due to the coronavirus pandemic has slowed the pace of industrial and economic activities in the state, which has also impacted the welfare of labourers and that makes this ordinance necessary.

The state government said in its statement that temporary exemption of labour laws in the state was necessary to encourage new investments, setting up new industrial infrastructure and for the benefit of existing industries and factories.

The ordinance has been sent to Governor Anandiben Patel for obtaining her approval.

The relaxations will be extended to existing industries and manufacturing units, as well as new ventures that set shop in the state in the coming days. All labour laws related to labour unions, settling work disputes, regulations for working conditions, contracts, etc will remain suspended for three years in Uttar Pradesh under this ordinance.

However, three laws related to labour have been relaxed which are; Bonded Labour System or Abolition Act of 1976; Employee Compensation Act of 1923 which states the statutory obligation upon an employer to accomplish his moral responsibility towards employees when they undergo any physical disabilities or diseases, while employment in dangerous working situations; Building and Other Construction Workers Act, 1996 for health, safety and welfare measures; and Section 5 of Payment of Wages Act, 1936 which makes sure that daily wages are done on time.

Provisions related to women and children will continue to exist and will not be suspended, the Uttar Pradesh government noted.
