On Tuesday, in front of the Top Court asks UP Police regarding the safety of the family and witnesses involved in the Hathras gang-rape case. The SC issued a notice to the UP Government asking what steps have been taken regarding the Hathras case.
Social activist Satyama Dubey and others filed a petition regarding the CBI probe or an SIT probe into the Hathras case which had evoked a national outrage.
The petition also highlighted the mishandling of the victim’s case by the Uttar Pradesh police. The police secretly cremated the victim’s body in the midnight. However, the police said that they had done the cremation in agreement with the victim’s family members.
Further, the court also questioned the women’s group for not approaching the Allahabad High Court.
When their lawyer Kirti Singh said they want a transfer of the case, which is already pending in the Allahabad High Court, Chief Justice of India SA Bobde said, “The Allahabad High Court is hearing the case… we can have the views of the High Court… If the High Court commits error, then we are here”. The court ensured the petitioners that the case seeks a smooth investigation.
“We want to know from all of you on what is the present scope of the Allahabad High Court’s proceedings,” said the court. Bobde, the Chief Justice also sought suggestions to widen the scope of the proceedings before the High Court.
The state government in an affidavit to the court said that the midnight cremation was done to avoid large scale violence which could happen the next morning.
The government said that a high alert was declared in the district due to a major law and order problem in view of the Babri masjid verdict which was about to come a day later.
The opposition condemned the Yogi Adityanath government as the UP police secretly cremated the body hurriedly without taking the permission of the family. The family was also kept locked inside the house. Even congress party along with other parties alleged that the cremation was a cover-up.
